20.04.2018 On March 28, 2018, the Institute held а webinar "On the Ulterior Purpose of Restrictions on Rights: the Case of Merabishvili against Georgia in the European Court of Human Rights"

On March 28, 2018 the Institute lawyer Dimitriу Mednikov conducted a webinar, during which he analyzed the decision of the Grand Chamber of the European Court of Human Rights of November 28, 2017, in the case of Merabishvili against Georgia (application no. 72508/13).

The webinar was attended by 36 participants including attorneys (17), lawyers (9), representatives of the academia (10) from 12 Russian regions (Moscow, St. Petersburg, Kazan, Yekaterinburg, Kaliningrad, Nizhny Novgorod, Sochi, Solnechnogorsk Moscow Region), Voronezh, Novosibirsk, Sovietsky (Yugra) and Sevastopol), as well as from Stockholm.

During the webinar, the following issues were considered:

  • How did the case law of the European Court on Article 18 of the Convention evolve?
  • Are rights of an applicant violated if a State interference pursues both a restriction purpose prescribed by the Convention and an ulterior purpose?
  • How to prove a violation of Article 18 of the Convention?

The review of the decision of the Grand Chamber of the European Court of Human Rights of the case of Merabishvili v. Georgia was published in April in No. 1 (25) of the International Justice Journal for 2018.
